Acceptable Use Policy & Community Guidelines
These Acceptable Use Policy and Community Guidelines (the “Guidelines”) set out the rules for using the Gem Space platform (the “Platform”), which is published and administered by Marketspace Solutions OU, a company incorporated under the laws of the Republic of Estonia, having its registered address at Harju maakond, Tallinn, Kesklinna linnaosa, Vesivärava tn 50-301, 10152 (“we”, “us” or “our”).

Gem Space is a space for people to connect, communicate, and share. These Guidelines exist to keep that space safe, lawful, and respectful for everyone. They form part of, and should be read together with, our Terms of Use, our Trust & Safety and Compliance Policy, and our Privacy Policy. By accessing or using the Platform, you agree to follow these Guidelines. Capitalised terms not defined here have the meaning given to them in the Terms of Use.

1. Scope and Application
1.1. These Guidelines apply to all users and to all content and conduct on the Platform, across every feature, including messages, voice and video calls, shared files and media, groups, channels, bots, profiles, usernames, and statuses.
1.2. We respect the privacy and confidentiality of users' private communications. We do not monitor private communications generally. We enforce these Guidelines primarily in relation to content that is reported to us, content that is made available to the public (such as public channels, bots, profiles, and usernames), and content that we are required to address under a valid order from a competent authority, as further described in our Trust & Safety and Compliance Policy.

2. Core Principles
We ask every member of the community to follow a few simple principles:
–      Be lawful. Do not use the Platform for anything that is illegal.
–      Be respectful. Treat others with respect, even when you disagree.
–      Be authentic. Be yourself, and do not deceive or impersonate others.
–      Respect others' rights. Respect other people's privacy, safety, and intellectual property.
–      Help keep the community safe. Report content or conduct that breaks these rules.

3. Illegal Content and Activity
You must not use the Platform to create, share, store, or distribute content, or to engage in conduct, that is illegal. This includes, without limitation:
–      child sexual abuse material, or any content or conduct that sexually exploits, endangers, or grooms children;
–      terrorist content, or content that incites, solicits, facilitates, or glorifies terrorism or violent extremism;
–      incitement to violence, hatred, or discrimination against persons or groups;
–      content or conduct that facilitates serious crime, including fraud, money laundering, trafficking in human beings, and the illegal sale of drugs, weapons, or other regulated or counterfeit goods;
–      infringement of intellectual property rights; and
–      any other content or activity that is unlawful under applicable law.

4. Safety and Respect for Others
You must not use the Platform to harm, threaten, or abuse others. This includes:
–      harassment, bullying, threats, intimidation, or stalking;
–      hate speech, or attacks on people based on protected characteristics such as race, ethnicity, national origin, religion, disability, sex, sexual orientation, or gender identity;
–      sharing intimate images of a person without their consent, or threatening to do so;
–      publishing or sharing another person's private or personal information without their consent (often called "doxxing");
–      gratuitously graphic or violent content, or content that glorifies violence or suffering; and
–      content that promotes, encourages, or provides instructions for suicide, self-harm, or eating disorders. Where appropriate, we may direct users to relevant support resources.

5. Sexual Content and Protection of Minors
5.1. Any sexual content involving, depicting, or sexualising a minor is strictly and absolutely prohibited, regardless of context or apparent consent, and will be reported to the competent authorities. This includes grooming, solicitation, and any attempt to sexualise a person under the age of 18.
5.2. Sharing or threatening to share intimate or sexual images of any person without their consent is prohibited.
5.3. You must not publish or distribute pornographic or sexually explicit material in publicly accessible parts of the Platform, including public channels, profiles, usernames, and avatars.
5.4. Access to the Platform is subject to the minimum age requirements set out in the Terms of Use. We take particular care to protect the safety of minors and may take additional measures, including age verification, to that end.

6. Authenticity and Platform Integrity
You must not undermine the security or integrity of the Platform or deceive other users. In particular, you must not:
–      impersonate any person or entity, or misrepresent your identity or affiliation;
–      send spam or unsolicited bulk messages, or engage in mass or automated unsolicited contact;
–      operate scams, phishing, pyramid schemes, or other fraudulent or deceptive schemes;
–      distribute malware, viruses, or malicious code, or attempt to gain unauthorised access to accounts, systems, or data;
–      create fake accounts, or use bots, scripts, or automation in a manner that breaches these Guidelines;
–      circumvent any suspension, termination, or security or access-control measure; or
–      engage in coordinated inauthentic behaviour or manipulation of the Platform or its users.

7. Respect for Privacy and the Rights of Others
7.1. You must not collect, store, or share other people's personal or confidential information without a lawful basis and, where required, their consent. You must respect the intellectual property rights and confidentiality obligations of others when sharing content on the Platform.

8. Channels, Bots, Groups, and Commercial Use
8.1. If you create or administer a public channel, group, or bot, you are responsible for the content you publish or allow others to publish there, and you are expected to moderate it in line with these Guidelines.
8.2. If you develop or operate a bot or integration on the Platform, you must ensure that it complies with these Guidelines, the Terms of Use, and applicable law.
8.3. Any commercial use, advertising, or promotion on the Platform must comply with these Guidelines, the Terms of Use, and applicable law, and must not be misleading.

9. Reporting Violations
9.1. If you come across content or conduct that breaches these Guidelines or is otherwise illegal, please report it using the reporting tools available within the Platform or by writing to us at support@gemspace.com. How reports are handled, including the information a report should contain, is described in our Trust & Safety and Compliance Policy.
9.2. Please use reporting responsibly. We may restrict the handling of reports from users who frequently submit reports that are manifestly unfounded.

10. Enforcement
10.1. Where we identify a breach of these Guidelines, we may take action that is proportionate to the breach, including removing or disabling access to content, restricting its visibility, issuing a warning, restricting access to certain features, or suspending or terminating the account concerned.
10.2. Where we take such action because of information provided by a user, we provide a statement of reasons and the opportunity to appeal, as described in our Trust & Safety and Compliance Policy and as required by the Digital Services Act.
10.3. Serious or illegal content may be reported to the competent authorities, and the relevant content and data may be preserved, as described in our Trust & Safety and Compliance Policy.
